ORDER

S.O. 1910(E)- Whereas the Department of Pharmaceuticals in the Ministry of Chemicals and Fertilizers vide S.O. No. 1221(E) dated 15.05.2013, in exercise of the powers conferred by Section 3 and 5 of Essential Commodities Act, 1955 has notified the Drugs (Prices Control) Order, 2013 (DPCO, 2013)

2.  And whereas the Ministry of Chemicals and Fertilizers vide S.O. 1394(E) dated the 30th May, 2013, in exercise of the powers conferred by Section 3 and 5 of Essential Commodities Act, 1955 has delegated the powers in respect of specified paragraphs of the DPCO, 2013, including paragraph 9 of the said order to be exercised by the NPPA on behalf of the Central Government.
3. And whereas  paragraph 9 (2) of the DPCO, 2013 provides that the Government may in due course of time come out with other appropriate mechanism  for collecting or obtaining the market based data related to drugs and the decisions of Government with respect to collection or obtaining of data shall be final.
4. And whereas, in exercise of power contained in paragraph 9(2) of the DPCO, 2013, an appropriate mechanism in collaboration with the National Informatics Centre as Integrated Pharma Database Management System (IPDMS) is in place to enable ‘manufacturer’ as defined in paragraph 2(n) of the DPCO, 2013 to make online submission of mandatory information / data specified in the various forms under Schedule-II of the DPCO, 2013.
5. All the manufacturers as mentioned in paragraph 4 hereinabove are  required to submit on-line, through IPDMS to the NPPA, Form-I, Form-II, Form-III, Form-IV and Form-V under Schedule-II, as provided under the relevant provisions of the DPCO, 2013 read with Essential Commodities Act, 1955.
