Sub. : Status of seven bulk drugs freed from price control by Mumbai High Court.

Sir,

The Mumbai High Court has delivered a judgement dated 31.08.2001, in which 7 bulk drugs namely, Salbutamol, Theophylline, Norfloxacin, Ciprofloxacin, Cloxacillin, Doxycycline and Glipizide have been freed from price control under DPCO’95 and all the price notifications in relation to the above mentioned bulk drugs and the formulations based on these bulk drugs have been set aside. The Government of India propose to file a Special Leave Petition in the Hon’ble Supreme Court of India, challenging the judgement order dated 31.08.2001.

All the State Drug Controllers are hereby informed that coercive processes under the provisions of DPCO’95 against the manufacturers, importers of distributors in respect of the seven bulk drugs mentioned above and theri related formulations may be kept in abeyance till further advice from this office, or till an appropriate stay order is issued by a competent Court.
