The President,
OPPI, IDMA, SSI Association.

Dear Sir,

The National Pharmaceutical Pricing Authority (NPPA) vide its Notifications No.S.O.685(E) dated 25th August, 1999 and S.O.No.736(E) dated 10th September, 1999 has fixed ceiling prices for Vitamin B Complex based formulations in capsule and tablet forms.

The pharmaceutical industry has sought clarifications on the scope of the above referred Notifications. It is clarified that above Notifications cover only tablets and capsules of Vitamin B Complex based formulations.

The Column (5) of Notification of 25th August, 1999 prescribed the ceiling prices for the composition given in Col.3 for such tablets and capsules of Vitamins. However, this ceiling price can be adjusted by the manufacturers within the permissible parameters as notified in “Important Note” I”. This adjustment of price, depending upon the variation from the composition as given in Column (3) can be both upwards and downwards. It is the responsibility of the manufacturer to adhere to the prescribed base ceiling price with its permissible variations for each formulation that he offers for sale.

It is further clarified that “Important Note “III” of Notification of 10th September, 1999 stipulates that where, on account of composition of the tablet or capsule, a company’s product necessitates fixation of separate price, the company is at liberty to get individual price fixed/refixed for its product from the NPPA, after the issue of Notifications referred to above.

Yours faithfully,

(A.K. Neog)
