ORDER

S.O. 2676(E) :-In exercise of the powers, conferred by sub-paragraph (1) of paragraph 3 of the Drugs (Prices Control) Order, 1995 read with the notification of the Ministry of Chemicals and Fertilizers S.O. No. 637 (E), dated the September 4, 1997 and in supersession of the order of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority) S.O. No. 536(E) dated 20th March 2008, in so far as it relates to Carbamazepine, except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority hereby fixes the price specified in column (4) of the Table given below as the maximum sale price (exclusive of excise duty and local taxes) at which the bulk drug specified in the corresponding entry in column (2) thereof shall be sold.

2.    This price/revised price shall be made effective within 15 days from the date of this order as required under sub paragraph (1) of paragraph 14 of Drugs (Prices Control) Order, 1995. The necessary price-list shall also be issued as required under sub-paragraph (3) of paragraph 14 of the Drugs (Prices Control) Order, 1995.

3.    The notified price specified in column (4) of the above table for Carbamazepine from basic stage of Ortho Nitro Toluene (ONT) will remain valid subject to the condition that the company concerned continues to manufacture the same from the basic stage of ONT and shall submit the details of production from the basic stage and intermediate stage separately by 10th of January, April, July and October of its preceding quarter to the Govt. / NPPA regarding its in-house production. In addition, the company shall also furnish corresponding details to the NPPA with regard to sales and distribution of the said bulk drug, indicating name(s) company-wise. If the production and sales details are not furnished by the concerned manufacturers, they will not be entitled to sell the said bulk drug at price indicated in Column (4) against item no. 1, instead they will be required to sell the same at a price not exceeding the price indicated in Column no. (4) against item no. 2.
